1.1 These Terms and Conditions of Sale (“Terms”) set out the basis on which The Regalia Florals Ltd (“we”, “us”, or “our”) supplies products to you, including floral arrangements and related items. In addition to our Website Terms of Use, these Terms apply to all purchases made through our website or via other methods (such as telephone or email). Please read them carefully before placing an order. By purchasing from us, you agree to be bound by these Terms.
1.2 When ordering through our website, you will be asked to confirm acceptance of these Terms by ticking a box at checkout before completing your purchase.

3. OUR SERVICE
3.1 Our mission is to deliver elegant, high-quality floral designs with exceptional customer care.
3.2 We provide ordering and delivery services across London and most parts of the UK (excluding the Channel Islands, Northern Ireland, and certain remote areas). Delivery options and availability are shown on our website for each product.
Orders
3.3 Once you place an order, we will send you an email confirming receipt of payment and acceptance of your order (the “Confirmation Email”). A binding contract is formed only when this email is sent.
3.4 Please ensure your contact details are accurate, as we use them to communicate about your order. Check your Confirmation Email carefully and notify us immediately of any errors.
Delivery
3.5 Your Confirmation Email will include the expected delivery date. When ordering online, you can select your preferred delivery date.
3.6 While we strive to meet delivery times, unforeseen circumstances such as traffic or adverse weather may cause delays.
3.7 Ensure the delivery address provided is complete and accurate, including postcode and a valid phone number. If the recipient does not respond within 10 minutes of our driver’s arrival, we may leave the premises, and a redelivery fee will apply. Alternatively, unless instructed otherwise, we may leave the order in a safe place.
3.8 Please inspect your delivery upon arrival and contact us promptly if there are any issues with quality or condition.
4. FLOWERS
4.1 All products are subject to availability. Flowers are natural and may vary in size, colour, and shape.
4.2 If supply issues arise, we may substitute items with alternatives of equal value and quality without prior notice.
4.3 If you have allergies, please contact us before ordering. We cannot guarantee that flowers are allergen-free.
4.4 Fresh arrangements typically last 2–5 days with proper care; some seasonal blooms may last 2–3 days.
4.5 Images on our website are for illustrative purposes only. Colours and appearance may differ slightly from those shown.
5. PRICE AND PAYMENT
5.1 Prices displayed exclude delivery charges unless stated otherwise.
5.2 We aim for accuracy, but errors may occur. If a product is incorrectly priced, we will notify you before dispatch and offer the option to cancel.
5.3 Prices may change at any time, but will not affect confirmed orders unless there is an obvious pricing error.
5.4 Payment is accepted via credit or debit card through our website. Once your order is confirmed, your card will be authorised and the amount reserved for payment.
6. REFUNDS
6.1 If you cancel your order before we begin processing and preparing it (see Section 7.1), we will issue a full refund.
6.2 Subject to Section 4.4, if your order arrives incorrectly or damaged, you may be eligible for a refund or replacement. Due to the perishable nature of flowers, you must notify us within one hour of delivery so we can resolve the issue promptly. Failure to report within this timeframe may affect your eligibility for a refund.
6.3 In cases where a refund is disputed, we will review the situation and aim to reach a fair resolution. However, our decision will be final.
7. CANCELLATION
7.1 Orders can be amended or cancelled before we start preparing them. Once we begin processing, the order becomes a “Started Order” and cannot be cancelled or refunded. To cancel, please contact us by email or phone. We will determine, at our sole discretion, whether an order is a Started Order.
7.2 We reserve the right to cancel an order at any time (for example, if a product is unavailable, payment cannot be authorised, or there is a pricing or description error). If we cancel your order, you will not be charged, and any payment already made will be refunded using the original payment method.
7.3 Please note: under the Consumer Contracts Regulations 2013, the statutory right to cancel does not apply to perishable goods such as flowers.
8. OUR LIABILITY
8.1 If you are a consumer, you have legal rights regarding products that are faulty or not as described. Nothing in these Terms affects those rights.
8.2 We do not exclude or limit liability for death or personal injury caused by our negligence, fraud, or breach of your statutory rights.
8.3 We are not liable for delays or failure to perform caused by events beyond our reasonable control or by actions or omissions on your part.
8.4 We are only responsible for foreseeable losses resulting from our breach of these Terms or failure to exercise reasonable care. Losses are foreseeable if they were obvious or discussed at the time of the order.
8.5 We are not liable for business-related losses, including lost profits, revenue, data, or opportunities.
8.6 You must follow any care instructions provided. We cannot accept liability for damage caused by failure to follow these guidelines.
8.7 We are not liable for allergic reactions or staining caused by flowers or materials unless you have specifically instructed us to avoid certain items and we fail to do so.
8.8 For business customers:
(a) We are not liable for indirect or consequential losses, including loss of profit.
(b) Our total liability is limited to the amount paid for the products under the relevant contract.
9. INTELLECTUAL PROPERTY
9.1 All designs, arrangements, photographs, artwork, and related materials created or provided by The Regalia Florals Ltd remain our intellectual property. You may not copy, use, or modify these materials without prior written consent.
9.2 We reserve the right to seek legal remedies, including injunctions, for any breach of this clause.
9.3 If you share images of our products on social media, please credit us using the hashtag #TheRegaliaFlorals.
10. GENERAL
10.1 These Terms represent the entire agreement between you and The Regalia Florals Ltd and override any prior discussions or arrangements.
10.2 No statement by any employee should be interpreted as altering these Terms unless confirmed in writing by us.
10.3 Each provision of these Terms operates independently. If any part is deemed unlawful or unenforceable, the remaining provisions will continue in effect.
10.4 Failure to enforce any right under these Terms does not constitute a waiver of that right.
10.5 No third party has rights under these Terms under the Contracts (Rights of Third Parties) Act 1999.
10.6 Your purchase is deemed to occur in the UK. These Terms and any disputes arising from them are governed by English law, and the English courts have exclusive jurisdiction.
11. Errors, Inaccuracies, and Omissions
From time to time, information on our website or within our services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, delivery charges, transit times, or availability.
We reserve the right to correct any such errors, inaccuracies, or omissions and to update information or cancel orders if any details on our website or related platforms are inaccurate at any time, without prior notice (including after you have submitted your order).
We are under no obligation to update, amend, or clarify information on our website or any related platform, including pricing details, except as required by law. Any stated update or refresh date should not be interpreted as confirmation that all information has been modified or remains current.
